Terms of Service

1. Who can join

You must be 18 or older. You apply with your own TikTok so we can see your style. Applications showing bought followers, bot engagement, or content that breaks a platform's rules are declined. If we decline your application you can apply once more; after a second decline you cannot apply again.

2. What Earn is

Earn (the Earn app and earnbycontent.com, operated by Brave New, Inc., a Delaware corporation, 131 Continental Drive, Suite 305, Newark, DE 19713, USA, Delaware file number 7689642) connects brands with creators for paid video work and manages the jobs, approvals and payments. We are not your employer and not your agent. Once you are selected you sign our Creator Agreement, which is in English; where it differs from these terms, the Creator Agreement applies to your paid work.

3. Jobs

• Every job shows the brand, the brief, the type of work, the number of videos, the deadline, the usage rights and the fee, including any view bonus, before you take it.
• Some jobs you reserve straight away; for others you apply and the brand picks. Some jobs open earlier for, or only to, creators at a higher level.
• Create videos: you film the video from the brief and hand over the file; the brand publishes it. Run an account: you publish the videos we send you on a campaign account, with no filming. Both: you film the video and publish it on the campaign account. Brand work is never posted on your own account.
• You can hand a reserved job back before you deliver, at no cost to you.
• Only work delivered within the job you took is paid.

4. Approval, fees and bonuses

• Every video is reviewed by our team and by the brand before it is published or accepted. We may ask for changes, as many rounds as needed. A video that is finally rejected for not matching the brief is not paid, not even in part.
• Published videos must be live on the campaign account with the required disclosure, and stay live for the agreed period. Deleting or hiding one early may reverse its fee.
• The fee for an approved video is fixed in your currency when you take the job. Exchange-rate changes after that are ours, not yours.
• Some jobs pay a bonus when a post reaches view levels shown in the job. We count a post's views from its public numbers when we check them, and our count decides. If you think a count is wrong, tell us within 7 days of it; we look at it again, and our decision is final.
• We do not guarantee any amount of work or earnings. Goals you set in the app are your own targets.

5. Payouts, identity check and invoices

• We pay approved fees and bonuses every week, on Friday, to the payout method you give us: a bank account, PayPal, Wise or Revolut. Keep it up to date.
• Before your first payout we may ask you to verify your identity once with our partner Sumsub. That payout waits until the check is done.
• Self-billing. You agree that we issue the invoices for our payments to you, in your name and on your behalf, from the invoice details you give us in the app. Each invoice is available to you in the app. If something on it is wrong, tell us within 8 days; otherwise it counts as accepted. Tell us straight away if your details change or if you become or stop being VAT-registered.
• You are responsible for the taxes and contributions on what we pay you, unless the law makes us deduct them.

6. Fraud

Fake or bought views, likes or followers, bots, reused or someone else's content, and misrepresenting who you are or who made a video are fraud. If we find fraud, we can withhold or take back the fees and bonuses for the affected work and close your account. We tell you what we found.

7. Disclosure and rules

All paid posts must carry the advertising disclosure included with the job (for example #ad) and use TikTok's branded content tools where available. You are responsible for following TikTok's terms and the advertising laws where you live. We will never ask you to hide that a post is paid.

8. Community rules and zero tolerance

Earn has zero tolerance for objectionable content and abusive users. This applies to everything written or uploaded in the app and on the website, including messages, files, briefs, feedback on videos and job offers, by creators, brands and our team alike. You must not post or send:

• harassment, bullying, threats or encouragement of self-harm;
• hate speech or slurs targeting anyone's race, ethnicity, religion, gender, sexual orientation, disability or nationality;
• sexual or nude content, or requests for it;
• violent or graphic content;
• spam, scams, fraud or attempts to take payment outside the agreed job terms.

Messages are checked automatically and those containing abusive language are not delivered. In a conversation with a brand, contact details, outside links and payment details are not delivered either: the collaboration and its payment stay on Earn. A brand's message that tries to move the work off Earn is held until our team has looked at it. In the app you can report any message, job or feedback, and you can block a conversation: the other side's messages disappear from your view at once and our team is notified. Blocked conversations are listed under Settings, where you can unblock them. We review every report and block within 24 hours. When content breaks these rules we remove it and remove the person or brand who posted it from Earn.

To use the app you must accept these terms before you sign in. Report anything urgent to hello@earnbycontent.com.

9. Levels, leaderboard and rewards

Your level, Score and badges come from your approved videos and how they perform. A higher level gives you earlier or wider access to jobs; it does not change the fee of a job. We may change how levels and the Score work. Once the leaderboard is open, other creators see your first name, TikTok handle, TikTok profile picture and your earnings for the period shown; you can hide yourself from it in the app. Rewards such as the Million club hoodie are gifts: they have no cash value, we send them to the address you give us, and we may change or end them.

10. Campaign accounts and content

A campaign account belongs to Earn, or to the brand where the job says so. We give you its login on earnbycontent.com. Keep the login private, do not change its email address or password unless we ask, and do not give the account to anyone. Follow our setup steps and TikTok's rules on it. When the work ends, or when we ask, stop using it; we may change its password at any time.

Usage rights for each video follow the job you take, including whether paid advertising use is included. You confirm that you have the rights to anything you film, including any music, people and locations in it.

Your own personal TikTok account stays entirely yours. We never ask for its password.

11. Ending things

You can stop at any time: delete your account in the app under Settings → Delete account, or email us. Deleting your account is final. Fees and bonuses you have already earned for accepted videos are still paid: we pay them to your payout account before your personal data is removed, and if we cannot, we keep the amount for you for 12 months, so write to us to claim it. Levels, badges and early access end with the account. We can suspend or close an account that breaks these terms, uses fake engagement, or misrepresents identity or work (see section 6); a person makes that decision and we tell you why.

12. Liability

We provide the service as-is. To the extent the law allows, our liability to you is limited to the fees and bonuses approved for you and not yet paid. Nothing here limits liability that cannot be limited by law.

13. The iOS app

If you use the Earn app on an Apple device, Apple's standard Licensed Application End User License Agreement also applies to the app. These terms are between you and us; Apple is not responsible for the service.

14. Law and changes

These terms are governed by the laws of the State of Delaware, USA. This does not take away any protection that the mandatory law of the country where you live gives you. If we change them in a way that matters, we will email you at least 14 days before the change applies to you.
